High Court adjourns Odex’s appeal to give lawyers more time
THE HOTLY-WATCHED High Court appeal by anime-distributor Odex to reverse an earlier decision that denied it access to Pacific Internet customers allegedly downloading pirated Japanese cartoons, has been adjourned. In a short in-chambers hearing on Wednesday morning, Judge Woo Bih Li agreed to grant an adjournment to allow Odex’s law firm Rajah and Tann so that it can ‘adduce’ or add more affidavits to support its case.
According to sources familiar with the case, the three new affidavits are from online tracking service BayTSP, Odex director Peter Go, and Dr Toh See Kiat.
Dr Toh, a lawyer, is the president of the Anti-Video Piracy Association of Singapore, and a former president of the Consumer Association of Singapore.
Pacific Internet’s (PacNet) law firm Alban Tay Mahtani & de Silva said that it is opposing the application, on the basis that such evidence should not be allowed to be introduced at this stage.
The new hearing date – also a closed-door affair – has not been fixed.

Amid furore, Odex changes tack
PUBLIC protests in Singapore are rare, but this particular one held last month was rarer still: A hodgepodge of toy robots, superheroes and aliens, together with a handful of anime fans assembled at the Youth Park, to protest against anime distributor Odex.
The police turned up, with four anti-riot vans, but nobody was arrested, although names and videos of the protest were taken.
In a way, the event is a microcosm of the state of civil society in Singapore, according to Dr Gillian Koh, senior research fellow at the Institute of Policy Studies.

Amid furore, Odex changes tack
EMBATTLED anime distributor Odex — facing scores of Netizens in a cyber piracy spat — has changed tack to discourage people from downloading the Japanese cartoon videos.
The company said yesterday that it would send warning letters through Internet service providers (ISP) SingNet, Pacific Internet (PacNet) and StarHub to stop people from downloading and sharing the videos.
Odex’s director Stephen Sing said he hoped the ISPs would agree to work with his company in passing on the notices to users who rip content.
“They don’t have any statutory obligations to do so, but we hope they could help,” he said.
The company has approached StarHub and would soon meet officials from the other two ISPs, he said.

Odex to get ISPs to issue online warnings
DISTRIBUTOR of Japanese animated movies, or anime, has adopted a new tactic in its battle to stop illegal downloads here.
The firm, Odex, will ask Internet service providers (ISPs) to forward warnings to subscribers it suspects of this activity, asking them to ‘cease and desist’.
Many in the online anime community here say Odex should have done this in the first place instead of a legal crackdown that sparked off an online hate campaign.
Since May, the firm has tried to get details of alleged infringers from ISPs here in order to send them letters demanding settlement sums of $3,000 to $5,000.
Spokesmen for the three ISPs said they have not yet been formally contacted by Odex and declined to disclose what they will do until they have more details.
Odex director Stephen Sing said the firm will not ask ISPs to disclose the identities of subscribers, but to forward an electronic notice from Odex to the alleged infringer.

Online lynching: What’s a firm to do?
Companies under attack must exercise care and take the right steps to arrest negative effects, say PR practitioners
AN ONLINE hate campaign is one of the toughest challenges a company can face but it can be countered, say public relations (PR) firms.
A virtual lynch mob will stop at nothing in trying to destroy a business, they warn.
That means companies under siege must be careful about how they tackle this kind of negative publicity, PR practitioners add.
In some cases, the mob cannot be reasoned with, so firms should choose the right battlefield – both online and off – to present their case, said PR agency Text 100′s practice lead Marc Ha.
During the good times, advertisers are increasingly turning to online channels such as virtual world Second Life, blogs and Web forums to reach Internet users. But when things turn nasty, they must tread warily.
One company at the centre of such an attack is Odex, a Singapore distributor of Japanese animated movies, or anime.
Internet users turned hostile – some even issued death threats – after Odex launched a legal campaign against anime piracy.
In Odex’s case, many Internet users argued their point in a reasonable, rational manner, but most went online to slam the company.
Some went further, making up lies to stir up public resentment. Some resourceful users dug up previous wrongdoings by Odex and its staff to further discredit the company.
Mr Ha said the obvious temptation is to jump in and counter the more outrageous online attacks but this could well be wrong.

Ongoing ODEX Saga : IP address unreliable way to identify users
Anime downloads may be act of moochers
Letter from Ravi Suppiah I refer to the letter, “Spare the rod and spoil the industry?” (Sept 7).
The ongoing Odex saga has indeed stirred up a hornet’s nest. I could not agree more with the letter writer’s premise that ultimately parents should take responsibility for their children’s online activities no matter how ignorant they may be.
But surely the law requires the accuser to prove his case explicitly and not merely declare guilt by sheer association.
In making its claim, it appears that Odex has chosen to use IP addresses to identify the users who have committed the infringement in question. Any IT hobbyist will counter that an IP address is a notoriously unreliable way to positively identify a user.

FANS transfer huge files of music, movies and software over the Internet, but content owners are fighting back using the same technology to monitor fan activity. Notice, however, that they are private entities carrying out this surveillance unregulated, so we must ask if some public oversight is called for.
Recently, a local firm called Odex tried unsuccessfully to get a court order to compel PacNet to disclose the identities of fans who allegedly downloaded its Japanese animation movies illegally. In court, it pointed out that the BitTorrent protocol that fans allegedly use to download its content is the very same thing that allows it to detect their activity too.
GIVE IPR DUE PROTECTION...
There is now a copyright enforcement system run by private entities – unregulated – in which intellectual property rights (IPR) trump privacy. And since there is a consensus in many societies to expand IPR, the courts have, by default, acquiesced to this too.
…BUT PRIVACY MATTERS TOO

Singapore anime figurine protesters meet real police
SINGAPORE, Sept 7 (Reuters) – A protest action by a group of Singaporeans with Japanese anime figurines such as the 5-inch tall Ultramen, robots and monsters with placards met some real-life police in the city-state.A handful of fans of Japanese anime had turned up at a Singapore public park on August 25 with armfuls of the toys to protest against a clampdown on Internet downloading of anime material by Singapore animation distributor Odex.
The incident was not reported in the local press, but pictures and accounts have started circulating on many blogs and political Web sites. (http://textfiend.net/zerohero/?p=454).
“The police didn’t stop us from what we wanted to do. But their being there was enough to intimidate,” the event’s organiser — who only wanted to be known by his online moniker Zer0 — told Reuters by telephone.
He added that police — who had four anti-riot vans at the scene — also took down the anime fans’ particulars and that they were filmed by plainclothes policemen. A police spokeswoman said she could not immediately comment.
Public protests are rare in Singapore, where outdoor demonstrations are banned and any public gathering of more than four people requires a permit.

OH ODEX, Its being a PR DISASTER
ON the surface, it was a righteous enforcement exercise. Good money was spent hiring top lawyers. The weight of the law was on their side.
But did local anime distributor Odex, now perceived as ‘download enemy No 1′, neglect a critical aspect of their action?
We’re talking about public relations (PR). We’re talking about being upfront and open – early.
Could the public relations nightmare it now faces have been avoided with a bit more transparency?
Last week, the beleaguered company finally organised a press conference to set the record straight. It was reactive, rather than proactive.
After nearly a month, it finally refuted rife public speculation that it could make up to $15 million in payments from errant downloaders, and accusations that it was a heavy-handed bully which targeted teenagers in its crackdown.
The answers are now out in the open. But whether they will placate the Internet community is another question.
